GB Biocides: Two Developments Your Portfolio Cannot Ignore

Two regulatory shifts are moving simultaneously in Great Britain, and the interaction between them matters.
GB Biocides & UK-EU SPS Agreement Updates
As of mid-2026, the regulatory landscape for biocidal products in Great Britain is undergoing significant shifts due to immediate amendments to the GB BPR and the broader strategic alignment under the upcoming UK-EU SPS Agreement. Below is a summary of the critical changes and immediate actions required.
1. The 2026 GB BPR Amendments (Effective 21 May 2026)
The Chemicals (Health and Safety) (Amendment, etc.) Regulations 2026 introduced three targeted changes to prevent market disruption and streamline administration:
Active Substance Expiry Extensions: Approved active substances with expiry dates between 23 June 2026 and 30 July 2031 are automatically extended to 31 July 2031 (provided renewal applications are properly submitted).
Essential Use Permits (Article 55(1)): Flexibility has been added for products addressing public/animal health emergencies. Essential products can remain on the market for up to 550 days OR until formally authorised if the need is unlikely to be temporary.
Data Protection (Article 60): Technical gaps have been closed to ensure data protection rules apply uniformly and accurately across all regulatory pathways for active substance approval and renewal.
2. The UK-EU SPS Agreement & Dynamic Alignment
The UK and EU are finalizing a Sanitary and Phytosanitary (SPS) Agreement (targeted for mid-2027) to reduce dual-regulatory burdens and protect agri-food supply chains. A central pillar of this agreement is the dynamic realignment of the GB biocides regime with EU rules.
Scope Impacts ALL 22 Product Types: Alignment covers the entirety of EU BPR (Regulation 528/2012). While agricultural and food biocides (PT3, PT4, PT8, PT14, PT18) are primary drivers due to export hygiene rules, all product types (PT1–PT22) would be dynamically bound to EU decisions. ECHA non-approvals or restrictions would automatically apply to GB.
Strict Exclusions: UK REACH, GB CLP, and GB PIC are completely excluded from this agreement and will remain independent, standalone GB regimes.
3. Required Actions
With GB transitioning back to EU BPR alignment, companies must take proactive steps to protect their portfolios:

If agreed to:
Portfolio Mapping: Cross-reference all current GB authorisations against EU BPR statuses immediately. EU phase-outs will dictate your product's future GB market access if the agreement is agreed to.
Dossier Re-evaluation: If EU applications were previously paused to focus strictly on the separate GB market, companies must urgently re-initiate EU compliance strategies to avoid 'hard stop' market disruptions in 2027.
