Ukraine REACH & CLP: Key Deadline Extensions Proposed

Ukraine is moving forward with its chemical safety regulations, aligning with EU standards. The Ministry of Economy and Ministry of Environment have published draft amendments to two key Cabinet of Ministers' resolutions:

  • Resolution No. 539 (May 10, 2024) – On the Classification, Labelling, and Packaging of Chemical Products

  • Resolution No. 847 (July 23, 2024) – On the Safety of Chemical Products

These amendments aim to provide businesses with adequate time to comply with the Technical Regulations on Chemical Safety and Classification, Labelling, and Packaging. The draft proposals are open for public consultation until November 2025 me.gov.ua.

Key Points:

  • Public Consultation: Open until November 2025

  • Proposed Extensions:

    • Preliminary State Registration: 26 Jan 2027

    • CLP Notification: 15 May 2026

    • ≥ 1 t/y CMR Cat. 1A or 1B substances, and ≥100 t/y substances very toxic to aquatic organisms (acute or chronic): 1 Oct 2028

    • > 1,000 t/y: 1 Oct 2029

    • 100 – 1,000 t/y: 1 Jun 2031

    • 1 – 100 t/y: 1 Mar 2033

  • Action Required: Stakeholders are encouraged to review and provide feedback on the draft amendments

For regulatory professionals, this means: companies placing chemicals on the Ukrainian market must review their portfolios now, identify tonnage bands, assess whether simplified registration via an EU REACH dossier may apply, and plan for the first critical deadline of October 2026. The extended timelines provide breathing room, but the compliance clock is running.
