Know Your Obligations: PCN Submission Deadline for Industrial Mixtures

With the deadline for submitting poison centre information in the new CLP Annex VIII format for industrial mixtures around the corner (1 January 2024), it's a good time for businesses to ensure they are ready to meet this deadline.

Background

Under Annex VIII to the CLP Regulation, importers and downstream users (formulators) placing mixtures classified as hazardous for human health or physical effects on the EU market must provide specific information on these mixtures to appointed bodies.

As of January 2021, the EU has harmonised the information requirements, and the information now needs to be prepared in an EU-harmonised Poison Centres Notification (PCN) format.

Notification Procedure

There are two options available for submitting information on industrial mixtures:

  • full submission or

  • limited submission

The limited submission option allows companies to provide the compositional information of the mixture as stated in the Safety Data Sheet, allowing them to protect their confidential information. However, to take advantage of this option, companies should be ready to provide additional information by telephone or email if requested in a health emergency. This service must be available 24/7, and the company must be able to provide the information in the language of the Member State where the mixture is placed on the market.

What information is required?

  • Identification of mixture and submitter: this includes a unique formula identifier (UFI), product category and product name

  • Hazard identification and additional information: includes hazard classification, label elements, available toxicological information, physical state and size etc.

  • Information on mixture components: A limited submission is made if a mixture is for industrial use only. The information on composition is limited to the information available in SDSs. For hazardous components which must be listed, identity and exact concentration or concentration range are needed

Who needs to notify?

Importers and downstream users placing hazardous mixtures on the EU market have a direct responsibility to submit Poison centre notifications (PCN).
