New fee rule published for TSCA

As of 1st October 2018, a new Fee Rule is now applicable under US TSCA. Manufacturers (including importers) who submit information to EPA under TSCA Sections 4 and 5 submissions, and for risk evaluations under TSCA section 6(b) must pay a fee. The new Fee Rule increases some of the fees under TSCA. For example the fee for a Pre-Manufacture Notice (PMN) has increased from $2,500 to $16,000. Some new fees have also been introduced. It should be noted that a significant discount of approximately 80% of the fees are applied to eligible small businesses.

You can review if your business is eligible for the small business discount by accessing the EPA’s Small Business Definition Guidance: https://www.regulations.gov/document?D=EPA-HQ-OPPT-2016-0401-0036
